These Terms and Conditions govern access to, browsing of, and use of the website of AGENTES PRIVADOS MOCH INC., as well as the contracting of professional services, digital products, courses, books, credentials, licenses, content, platforms, forms, institutional resources, and any other service or product offered directly or indirectly by the organization.

By accessing the website, submitting a form, requesting information, contracting a service, making a payment, purchasing a product, enrolling in a course, accessing an educational platform, requesting a credential, applying for a license, or using any resource connected to AGENTES PRIVADOS MOCH INC., the User/Client declares that they have read, understood, and accepted these Terms and Conditions.

AGENTES PRIVADOS MOCH INC. identifies itself as an international private investigation organization founded in 1977, dedicated to professional investigation services, international training, methodology, specialized literature, credentials, private accreditation, and the development of the DSP / PSD System.


2. Professional Code of Ethics

AGENTES PRIVADOS MOCH INC. declares its adherence to principles of confidentiality, legality, discretion, professional responsibility, respect for human dignity, and commitment to truth.

The organization maintains as institutional references its professional ethics works, including:

  • Código de ética del detective privado.
  • Code of Ethics of Private Detectives.

These materials form part of the organization’s doctrinal, academic, and professional framework, without prejudice to the legal rules applicable in each country, state, province, or jurisdiction.


3. Purpose and Scope of Application

These Terms and Conditions govern:

  • Access to and use of the Website.
  • The contracting of private investigation, verification, documentation, analysis, and professional consulting services.
  • The contracting of international service evaluation services.
  • The purchase of books, manuals, courses, documents, templates, and digital products.
  • Access to academic platforms, courses, and training content.
  • The issuance of diplomas, certificates, credentials, accreditations, or private licenses connected to the DSP / PSD System.
  • The relationship of the User/Client with MOCH INC. and its associated platforms.

Acceptance of these Terms implies the express adherence of the User/Client to the version in force and published at the time of contracting, purchase, request, or use of the Website.


4. Contractual Provider and Scope of Responsibility

4.1 Contractual Provider

MOCH INC. is the sole contractual party responsible for the services, products, courses, content, credentials, licenses, or resources offered through this Website, unless another contracting entity is expressly indicated in writing.

4.2 Role of AGEPRIMOCH Cía. Ltda.

In Ecuador, AGEPRIMOCH Cía. Ltda. may act solely as a consultant, administrative coordination center, logistical support provider, or operational support entity for certain activities connected to Ecuadorian territory.

AGEPRIMOCH Cía. Ltda. does not act as a contractual party with the client unless there is a separate document, specific contract, independent invoice, or express written acceptance.

4.3 Collaborators, Investigators, and Contractors

Services may be performed by internal personnel, investigators, detectives, collaborators, consultants, or independent contractors, always within the framework authorized by MOCH INC. and according to the conditions of each case.

External collaborators or independent contractors are not employees of MOCH INC., unless an express and documented employment relationship exists.


5. Nature of Professional Services

Private investigation, verification, analysis, documentation, and professional consulting services are personalized, confidential, professional, and subject to prior evaluation.

Services may begin immediately once payment has been confirmed, the request has been accepted, the scope has been defined, and the corresponding resources have been assigned.

The nature of the services constitutes a best-efforts obligation and not an obligation to achieve a specific result. MOCH INC. does not guarantee specific results, specific findings, subjective satisfaction, assured success, economic recovery, judicial acceptance, a specific legal consequence, third-party reaction, or a favorable decision for the client.

The results of an investigation depend on external factors, availability of information, behavior of third parties, operational conditions, legal limits, available time, case complexity, client cooperation, and circumstances that are not always under the organization’s control.


6. Prior Evaluation and Case Acceptance

The submission of a form, email, message, inquiry, preliminary payment, or service request does not guarantee acceptance of the case.

MOCH INC. may evaluate each request considering:

  • Country, city, and applicable jurisdiction.
  • Type of case.
  • Client’s objective.
  • Available information.
  • Legality of the request.
  • Operational feasibility.
  • Ethical or reputational risks.
  • Need for authorized collaborators.
  • Estimated timeframe.
  • Expected scope of the report or result.

MOCH INC. reserves the right to accept, reject, coordinate, refer, suspend, or terminate any request that does not comply with its legal, ethical, professional, or operational standards.


7. Services Not Accepted

MOCH INC. does not accept, promote, perform, facilitate, or coordinate requests related to:

  • Hacking or illegal access to systems, accounts, devices, emails, social networks, or databases.
  • Unauthorized interception of communications.
  • Identity impersonation.
  • Harassment, intimidation, persecution, or illegal surveillance.
  • Violation of privacy.
  • Unlawful obtaining of confidential information.
  • Installation of spyware, malware, or unauthorized surveillance tools.
  • Fabrication, alteration, or manipulation of evidence.
  • Activities contrary to law, morality, public order, or professional ethics.

The User/Client declares that the information provided is truthful, lawful, and that the purpose of the request does not pursue an illegal objective.


8. Use of the Website

Access to the Website is free of charge, without prejudice to products, services, courses, books, credentials, or resources that may require payment.

The User agrees to use the Website only for lawful purposes and in accordance with these Terms and Conditions.

It is expressly prohibited to use the Website to:

  • Request illegal services.
  • Submit false, malicious, or fraudulent information.
  • Violate third-party rights.
  • Copy, reproduce, or exploit content without authorization.
  • Attempt to damage, overload, interfere with, or compromise the operation of the Website.

9. Intellectual and Industrial Property

10. Academy, Courses, and Professional Training

The courses, books, manuals, videos, documents, academic programs, Moodle platforms, credentials, certificates, diplomas, accreditations, and private licenses offered by MOCH INC. are intended for educational, training, methodological, and private professional development purposes.

Participation in a course, reading of a book, or obtaining a diploma, certificate, credential, accreditation, or private license does not automatically authorize the User to work as a private investigator or detective in any country, state, province, or jurisdiction.

Legal authorization to perform private investigation activities depends exclusively on the laws, regulations, competent authorities, and requirements applicable in each territory.

The User is responsible for verifying the legal requirements of their country, state, or jurisdiction before offering or providing private investigation services.


11. Diploma, Certificate, Credential, Accreditation, and DSP / PSD License

MOCH INC. may issue private institutional documents related to training, studies, credentials, accreditation, membership, renewal, or DSP / PSD license, according to its internal policies.

These documents are private and institutional in nature. They do not constitute government licenses, state authorizations, or official qualifications to practice a regulated profession, unless expressly recognized by the competent authority.

MOCH INC. may deny, suspend, revoke, or refuse to renew credentials, accreditations, or private licenses in cases of:

  • False information.
  • Misuse of brand.
  • Unethical conduct.
  • Violation of these Terms.
  • Non-payment.
  • Unauthorized use of materials.
  • Actions that affect the organization’s institutional reputation.

Denial, suspension, revocation, or non-renewal does not automatically create a right to a refund.


12. Books, Digital Products, and Downloadable Materials

Books, manuals, guides, templates, videos, documents, courses, downloadable files, digital credentials, digital certificates, and other digital products are protected by intellectual property rights.

The User may not copy, reproduce, resell, distribute, publish, share, upload to the internet, transfer, translate, modify, or commercially exploit such materials without the express written authorization of MOCH INC.

Access to digital products may be suspended or canceled in cases of misuse, unauthorized distribution, chargeback abuse, copyright infringement, or violation of these Terms.


13. Payments

Payments may be made through payment platforms, online stores, bank transfers, payment links, external processors, WooCommerce, banks, digital gateways, or other authorized methods.

Prices, taxes, commissions, administrative charges, shipping costs, processing fees, availability, and conditions may change without prior notice.

When a payment corresponds to a service that requires prior evaluation, such payment does not imply automatic acceptance of the case unless expressly confirmed by MOCH INC.

The User/Client is responsible for reviewing the description of the product, service, course, book, credential, or license before making payment.


14. General Refund, Return, and Warranty Policy

14.1 No Refund for Services Already Started

Because these are professional, personalized, confidential services that may begin immediately, returns or refunds are not accepted once the investigation, consulting, evaluation, coordination, or service process has started.

This includes voluntary cancellations, changes of mind, subjective expectations of the client, dissatisfaction with non-guaranteed results, or impossibility of obtaining certain information due to external causes.

14.2 No Satisfaction Guarantee or Guaranteed Result

The results of an investigation depend on multiple external factors. Therefore, MOCH INC. does not offer a satisfaction guarantee, assured success, specific finding, judicial acceptance, economic recovery, or specific result.

14.3 Exceptional Review Window

An extraordinary review may only be considered if all of the following conditions are met:

  • The service has not started.
  • Access to content, courses, or materials has not been granted.
  • No report, document, credential, or material has been issued.
  • The request is submitted within the first 24 hours after payment.

In such cases, MOCH INC. may, at its sole discretion, offer credit, rescheduling, change of service, administrative review, or partial refund, deducting administrative costs, bank fees, or expenses already incurred.

14.4 Digital Products

Access to courses, licenses, manuals, digital books, templates, documents, downloadable content, or digital materials is non-refundable from the moment access is granted, the file is sent, the platform is activated, or the content is delivered.

14.5 Credentials, Accreditations, and Licenses

Payments related to applications, issuance, renewal, review, accreditation, or DSP / PSD license are generally non-refundable once the administrative or evaluation process has started.

14.6 Specific Policies by Platform

Each online store, payment gateway, or associated platform may have specific refund, return, and warranty policies. Such policies are deemed accepted by the User when making payment through the corresponding platform.


15. Chargebacks, Bank Disputes, and Payment Claims

The User/Client agrees to contact MOCH INC. first before initiating a chargeback, bank dispute, or claim before a payment gateway.

When a service has started, a course has been activated, a digital product has been delivered, an evaluation has begun, or a credential/license is in process, the User acknowledges that the payment may be non-refundable under these Terms.

In cases of abusive, fraudulent, or improper chargebacks, MOCH INC. may suspend services, access to courses, credentials, licenses, reports, digital products, or any associated resource, without prejudice to recovering administrative costs, commissions, defense expenses, or resulting damages.


16. Information, Documents, and Content Submitted by the User

The User/Client declares that all information, documents, photographs, videos, screenshots, messages, files, data, testimony, or content submitted to MOCH INC. are lawful, truthful, of legitimate origin, and that the User/Client has sufficient right or authorization to submit them.

The User/Client shall be responsible for the accuracy, legality, originality, ownership, and purpose of the information provided.

The User/Client shall hold MOCH INC. harmless from claims, damages, losses, penalties, or liabilities arising from false, unlawful, unauthorized, manipulated, incomplete information, or information submitted in violation of third-party rights.

The submission of information to MOCH INC. does not imply authorization for public, commercial, or indiscriminate disclosure. The information will be used only for evaluation, service provision, analysis, documentation, administration, legal defense, legitimate collection, or compliance with legal obligations, as applicable.


17. Information Generated During Investigations, Reports, and Documentation

Information, reports, photographs, videos, notes, documents, analyses, records, chronologies, files, or materials generated during an investigation form part of the professional work developed by MOCH INC. or its authorized collaborators.

The partial or total delivery of such information to the User/Client shall be subject to:

  • Full payment of the service, unless otherwise agreed in writing.
  • Corresponding internal authorization.
  • Contracted scope.
  • Legal and ethical limits.
  • Confidentiality conditions.

MOCH INC. may retain reports, documents, results, access, or deliverables when there are pending payments, payment disputes, chargebacks, contractual breaches, or legal risks.


18. Retention and Deletion of Information

MOCH INC. may retain case information for the time necessary to provide the service, deliver reports, comply with administrative obligations, respond to client requests, address claims, document payments, comply with legal requirements, or defend its rights.

As a general operational policy, information delivered to the client may remain in sending systems, email, cloud storage, or delivery platforms for a limited period. It may subsequently be transferred to internal backup and later deleted according to internal security and document retention processes.

Once information has been deleted from backup systems, recovery may be impossible.

Retention periods may vary depending on the type of service, applicable law, tax obligations, disputes, pending payments, legal requirements, or institutional defense needs.


19. Confidentiality

MOCH INC. acknowledges that private investigation, verification, analysis, consulting, and training services may involve sensitive, personal, family, business, technical, financial, commercial, legal, or confidential information.

MOCH INC. will adopt reasonable measures, within its possibilities and the state of technology, to protect the confidentiality of information received and generated.

Confidentiality will apply mainly to:

  • Identity of the requester.
  • Information provided by the client.
  • Information of the person or entity subject to verification.
  • Documents, images, videos, and files submitted.
  • Reports, findings, and results.
  • Internal and external communications related to the case.

MOCH INC. may limit internal access to case information, filter sensitive data when necessary to assign tasks, avoid conflicts of interest, and protect the identity of the requester.

The delivery of reports or results shall be made through the means authorized by MOCH INC., preferably to the email address or contact channel authorized by the client.


20. Exceptions to Confidentiality

Confidentiality may be limited or excepted when necessary to:

  • Perform the contracted service.
  • Coordinate authorized collaborators.
  • Comply with legal obligations.
  • Respond to valid requests from competent authorities.
  • Defend the rights of MOCH INC.
  • Manage pending payments or legitimate collection.
  • Prevent fraud, abuse, threats, or misuse of the service.
  • Comply with tax, administrative, or contractual obligations.

In the event of debt, non-payment, chargeback, dispute, or economic breach, MOCH INC. may provide legal, accounting, administrative, or collection advisors only with the information necessary to document and manage the collection, seeking to limit the exposure of sensitive data not required for such purpose.


21. Legal or Authority Requests

If MOCH INC. receives an order, request, subpoena, formal requirement, or legal mandate issued by a competent authority, it may respond in accordance with applicable law, its rights, duties, internal procedures, and legal advice.

MOCH INC. does not guarantee indefinite retention of information or files. Information may be subject to internal retention, deletion, backup, or purge policies, unless a specific legal preservation obligation applies.

No provision of these Terms shall be interpreted as authorization to obstruct justice, destroy legally required evidence, fail to comply with valid orders, or evade legal obligations.


22. Independence of Third Parties, Collaborators, and External Platforms

Detectives, investigators, consultants, collaborators, providers, technicians, instructors, platforms, payment processors, distributors, or external service providers may act as independent contractors and not as employees of MOCH INC., unless an express relationship states otherwise.

MOCH INC. shall not be responsible for individual acts of third parties performed outside the authorized operational framework or in violation of instructions, laws, agreements, or professional standards.

MOCH INC. shall not be responsible for damages arising from third parties when such damages are caused by:

  • Violation of law, morality, or public order by third parties.
  • Viruses, codes, files, or external malicious programs.
  • Infringement of intellectual property rights or trade secrets by third parties.
  • Illegal, misleading, unfair advertising or unfair competition carried out by third parties.
  • Lack of truthfulness, accuracy, quality, relevance, or timeliness of third-party content.
  • Violation of rights to honor, privacy, image, or third-party rights.
  • Non-performance, delay, defective performance, or termination of obligations assumed by third parties.

23. Third-Party Links and Platforms

24. Limitation of Liability

The validity of these Terms coincides with the time of their publication until they are replaced or modified.

MOCH INC. may suspend, restrict, or terminate access to the Website, content, courses, digital products, credentials, licenses, accounts, or services when there is a breach of these Terms, misuse, legal risk, non-payment, abuse, fraud, or technical/administrative need.

Termination or suspension shall not affect the User’s pending obligations, nor the prohibitions related to intellectual property, confidentiality, payments, limitation of liability, and use of information.


26. Applicable Law, Jurisdiction, and Arbitration

26.1 Applicable Law

These Terms and Conditions, as well as any contractual relationship with MOCH INC., shall be governed by the laws of the State of Florida, United States, excluding its conflict of law rules.

26.2 Exclusive Forum

Unless otherwise required by mandatory law, any dispute shall be submitted exclusively to the state or federal courts located in Miami-Dade County, Florida, United States.

26.3 Individual Arbitration

Any controversy arising from these Terms, the Website, services, products, courses, credentials, licenses, or contractual relationship with MOCH INC. may be resolved through individual and confidential arbitration, administered by the American Arbitration Association (AAA) or JAMS, seated in Miami-Dade County, Florida, in accordance with their applicable rules.

The User/Client waives, to the extent permitted by law, the right to participate in class actions, representative actions, collective arbitrations, or consolidated proceedings against MOCH INC.


27. Express Acceptance

By using the Website, submitting a request, contracting a service, making a payment, purchasing a product, accessing a course, requesting a credential, applying for a license, or interacting with MOCH INC., the User/Client expressly declares that:

  • They have read, understood, and fully accepted these Terms and Conditions.
  • They accept the no-refund and no-satisfaction-guarantee policy.
  • They acknowledge that professional services are best-efforts obligations and not result-guarantee obligations.
  • They acknowledge that the main contractual relationship is with MOCH INC., unless a separate document provides otherwise.
  • They acknowledge that AGEPRIMOCH Cía. Ltda. may act only as a consultant or administrative support entity in Ecuador, without assuming direct contractual responsibility unless expressly agreed.
  • They accept the legal, ethical, and professional limits of the organization.
  • They declare that they will not request unlawful, illegal, or unethical services.
